DOJ Backs FERC In Enviros’ Pipeline Powers Challenge – Law360

The U.S. Department of Justice on Tuesday told a Washington, D.C., federal judge that environmental groups’ challenge to the Federal Energy Regulatory Commission’s pipeline approval process would “cripple” FERC’s ability to fulfill its responsibilities and harm other agencies as well.

Delaware Riverkeeper Network has alleged that FERC is “subject to an impermissible temptation to be biased in favor of the private companies” because of its reliance on regulatory fees from industry for its budget, but in a statement of interest, the DOJ said the nonprofit’s lawsuit…
