2nd Circ. Asked To Rethink $9.5B Chevron Pollution Battle – Law360

Law360, Los Angeles (September 16, 2016, 11:00 PM EDT) — Representatives for indigenous Ecuadoreans asked the Second Circuit on Friday to re-evaluate its August ruling that an unprecedented $9.5 billion oil pollution judgment against Chevron in Ecuador was fraudulently produced and could not be enforced, saying the trial judge lacked legal authority to deem the Ecuadorean judgment invalid.

In asking for en banc rehearing, Hugo Camacho Naranjo and Javier Piaguaje Payaguaje, two plaintiffs representing indigenous Ecuadorean communities in the Amazon Basin, are challenging an appellate panel’s affirmation of a New York federal judge’s ruling prohibiting enforcement…
